Investigation initiated after contentious ruling dismisses prominent fraud case
The Magistrates Commission has initiated an investigation into retired Senior Magistrate Tuletu Tonjeni following a complaint lodged by the National Prosecuting Authority (NPA) regarding her management of a contentious fraud and money laundering case involving taxi operator Joe “Ferrari” Sibanyoni.
This inquiry represents a new development in a legal situation that has faced significant backlash from prosecutors, legal analysts, and civil society groups. Central to the investigation is Tonjeni’s choice to dismiss the case from the court’s calendar after a state prosecutor was absent, a decision that sparked discontent within South Africa’s judicial system.
NPA spokesperson Kaiser Kganyago confirmed that the investigation officially commenced today.
The Magistrates Commission will review the events surrounding Tonjeni’s decisions during the May 2026 court session. Senior Prosecutor Mkhuseli Ntaba, who was found in contempt of court during the same proceedings, is expected to provide testimony in the inquiry.
The controversy began during a high-profile hearing where Sibanyoni and three co-defendants faced allegations related to fraud, extortion, and money laundering.
According to the prosecution, the defendants were accused of extorting around R2.2 million from a local entrepreneur.
Tensions escalated when State Prosecutor Mkhuseli Ntaba was unable to attend scheduled bail proceedings. Reports indicated that members of the prosecution team had expressed safety concerns linked to the accused syndicate.
Instead of delaying the proceedings, Tonjeni ruled that ongoing postponements had become excessive. She dismissed the case from the court roll and found Ntaba guilty of contempt of court, a decision that sharply polarized opinions within South Africa’s legal circles.
The rulings faced immediate and fierce criticism.
In response, the NPA filed a formal complaint with the Magistrates Commission, alleging significant procedural errors. Among the issues raised were accusations that Tonjeni had used inappropriate language during the proceedings and acted beyond her judicial authority by taking actions that the prosecutors argued were outside the scope of the court’s powers.
The debate surrounding the case transcended the courtroom.
The South African National Christian Forum (SANCF) publicly requested that the Minister of Justice and Constitutional Development investigate the ruling’s circumstances. The organization questioned whose interests were benefited by the release of the accused and called for a thorough examination of the issue.
Additionally, the NPA swiftly sought permission to appeal Tonjeni’s decisions in the High Court.
Soon after, the criminal case against Sibanyoni and his co-defendants was successfully re-enrolled in the Delmas Regional Court, allowing the prosecution to advance despite prior setbacks.
Public scrutiny peaked further when Tonjeni announced her retirement from the bench on 29 May 2026, just days after the NPA submitted its complaint to the Magistrates Commission.
While she had officially communicated her intention to retire a year earlier in 2025, the timing of her departure drew criticism from various observers, who maintained that lingering accountability issues had not been addressed.
The findings of the Magistrates Commission’s investigation are now anticipated to determine whether any disciplinary measures will occur despite Tonjeni’s retirement.
This case continues to engage the public’s interest as it raises important issues regarding judicial accountability, the independence of prosecution, and public trust in South Africa’s criminal justice framework.
