NPA Appeals Timothy Omotoso Acquittal in Gqeberha High Court on Monday

The National Prosecuting Authority (NPA) will appeal the acquittal of Nigerian televangelist Timothy Omotoso at the Gqeberha High Court on Monday. The appeal process, initiated on July 14, follows a directive from Judge Irma Schoeman to clarify factual findings in her judgment, which is crucial for the state’s legal course after the high-profile trial.

The NPA’s Appeal Process

The National Prosecuting Authority (NPA) will commence its appeal process against Timothy Omotoso’s acquittal on July 14, 2023, at the Gqeberha High Court.

NPA spokesperson Mthunzi Mhaga stated, “This is the only limited mechanism by which the state can appeal an acquittal judgment in South African law.

Judge Irma Schoeman’s directive to clarify her earlier judgment is crucial for the NPA to proceed with its legal question reservations under Section 319.

Omotoso’s Legal Troubles and Deportation

Timothy Omotoso was acquitted of serious charges including rape in April 2023, after a lengthy trial that captured national attention.

Following his acquittal, Omotoso was reported to have been deported to Nigeria, labeled a prohibited person by the Department of Home Affairs.

He is barred from returning to South Africa for the next five years, according to the Department, highlighting significant legal controversies surrounding his case.


The National Prosecuting Authority is set to return to the Gqeberha High Court to appeal against the acquittal of Nigerian televangelist Timothy Omotoso, following a lengthy legal battle.

On July 14, the NPA will initiate its appeal process, seeking clarification on the factual findings of Judge Irma Schoeman’s judgment, which is necessary for further legal proceedings.

Timothy Omotoso, who faced serious charges, including rape and human trafficking, was acquitted earlier this year, but the NPA is determined to contest the verdict in court.

Omotoso’s case has garnered national attention, and his deportation to Nigeria adds another layer of complexity to the ongoing legal saga surrounding the controversial pastor.
