Individuals in South Africa can now file qualifying civil claims of up to R30,000 in the Small Claims Court without the need for legal representation during hearings.<\/p>\n

This updated monetary limit came into effect on 1 August 2026, marking an increase from the previous cap of R20,000 and representing the first adjustment since 2019.<\/p>\n

According to the Department of Justice and Constitutional Development, this change aims to enhance access to a quicker and more cost-effective method for resolving common disputes.<\/p>\n

In the last financial year, over 36,600 matters were registered in Small Claims Courts, with a total value nearing R257 million.<\/p>\n

Understanding the Small Claims Court<\/strong><\/h2>\n

The Small Claims Court is set up to handle certain civil disputes involving private individuals. Its processes are simpler compared to those of the Magistrate\u2019s Court or the High Court.<\/p>\n

A commissioner, who may serve in various professional roles including attorney, advocate, or even a practitioner from Legal Aid South Africa, oversees the hearings without payment.<\/p>\n

Legal representation is not allowed during hearings, although parties can seek legal advice beforehand.<\/p>\n

Currently, there are 418 Small Claims Courts across South Africa, typically located in Magistrates\u2019 Courts, many of which hold sessions after regular business hours.<\/p>\n

Claim Amounts<\/strong><\/h2>\n

Claims can be made for amounts up to R30,000 if the dispute lies within the court\u2019s jurisdiction.<\/p>\n

If a debt exceeds R30,000, the claimant has the option to abandon the excess and pursue only the R30,000 through the Small Claims Court.<\/p>\n

For instance, if owed R35,000, a claimant might choose to limit their claim to R30,000, potentially forfeiting the remaining R5,000 unless they file another claim.<\/p>\n

The Small Claims Court can handle qualified disputes related to:<\/p>\n

    Small Claims Courts typically do not handle:<\/p>\n

    • Cases against the State<\/li>\n
    • Divorce or annulment proceedings<\/li>\n
    • Disputes regarding wills<\/li>\n

      Who Can File a Claim?<\/strong><\/h2>\n

      Natural persons may initiate a claim in the Small Claims Court.<\/p>\n

      Corporations and organizations generally cannot bring cases to this court, but individuals may file claims against businesses or legal entities.<\/p>\n

      Claimants must usually be at least 18 years old; minors require assistance from a parent or guardian.<\/p>\n

      Step 1: Attempt to Resolve the Dispute<\/strong><\/h3>\n

      Before initiating court actions, communicate directly with the other party to attempt a resolution.<\/p>\n

      Maintain documentation such as messages, emails, invoices, agreements, and receipts, as they may serve as important evidence later.<\/p>\n

      Step 2: Send a Letter of Demand<\/strong><\/h2>\n

      If no resolution is achieved, forward a formal letter of demand to the opposing party.<\/p>\n

      This letter should clearly outline:<\/p>\n

      • The claimant\u2019s identity<\/li>\n
      • The reason for the owed money or property<\/li>\n
      • The claimed amount<\/li>\n
      • The due date for payment or performance<\/li>\n

        Step 3: Visit the Court Clerk<\/strong><\/h2>\n

        If the 14-day deadline passes without response or payment, visit the clerk of the Small Claims Court at the appropriate Magistrate\u2019s Court.<\/p>\n

          Step 4: Issuing a Summons<\/strong><\/h2>\n

          Should the claim be eligible, the clerk will assist in preparing a summons detailing when and where the defendant must appear.<\/p>\n

          It is essential that the summons is properly served to the defendant, which can be done by the claimant or the sheriff.<\/p>\n

          While legal representation isn’t required, there may be costs associated with sheriff’s services.<\/p>\n

          Proof of service must be submitted to the court by the hearing date.<\/p>\n

          Step 5: Prepare for Court<\/strong><\/h2>\n

          Organize evidence in chronological order and prepare a concise explanation that covers:<\/p>\n

            Proceedings in Court<\/strong><\/h3>\n

            Proceedings in the Small Claims Court are intentionally informal.<\/p>\n

            The commissioner will allow both parties to present their cases, submit evidence, and respond to inquiries. The commissioner may also engage with witnesses and review documentation.<\/p>\n

            It is crucial for parties to maintain respect, answer questions honestly, and follow the commissioner\u2019s instructions.<\/p>\n

            The commissioner possesses the authority to rule on the case or take other permissible actions.<\/p>\n

            If the Defendant Fails to Appear<\/strong><\/h3>\n

            Should the defendant be properly served yet not attend court, a default judgment may be issued after evaluating the claimant\u2019s evidence.<\/p>\n

            A claimant must still substantiate their claim, as an absence does not guarantee victory.<\/p>\n

            If the Defendant Doesn’t Pay<\/strong><\/h3>\n

            Winning a case does not ensure immediate payment.<\/p>\n

            If the judgment debtor does not comply, enforcement actions may proceed through the Magistrate\u2019s Court, with guidance available from the clerk.<\/p>\n

            Additional costs, including fees for the sheriff, may apply during enforcement.<\/p>\n

            Appealing a Small Claims Court Decision<\/strong><\/h3>\n

            Typically, one cannot appeal the merits of a Small Claims Court ruling.<\/p>\n

            However, a review may be pursued in the High Court on specific legal or procedural grounds, such as jurisdiction issues or procedural errors.<\/p>\n

            A review does not serve as an opportunity to reargue the case.<\/p>\n
