\"AttentionThe South African Revenue Service (SARS) has begun sending out final demand notices to trusts that have yet to file their tax returns, signaling the end of the temporary reprieve that was in place earlier this year.<\/p>\n

Back in February 2026, SARS dispatched final demand letters to a number of trusts that had not submitted their income tax returns, providing a 21-day window for compliance.<\/p>\n

Failure to meet tax return obligations can lead SARS to impose administrative penalties that may vary from R250 to R16,000 each month.<\/p>\n

Once the final demands were issued, concerns were raised regarding the legitimacy of the penalties issued due to the timing of the notices alongside a pertinent public announcement.<\/p>\n

For SARS to enact such administrative penalties, a supporting public notice is required to indicate the nature of the non-compliance.<\/p>\n

While final demand letters for penalties directed at trusts were sent out in February 2026, the necessary public notice was only released on 27 March.<\/p>\n

This public notice, issued after the final warnings, has led to questioning the reliability of the demands that were made prior to its publication.<\/p>\n

In light of this issue, SARS conducted multiple discussions with stakeholders to devise a strategy, ultimately deciding to postpone the penalties.<\/p>\n

On 6 July 2026, SARS announced the cancellation of penalties for trusts that did not file income tax returns for the 2024 and 2025 tax years.<\/p>\n

Despite the concerns regarding the issuance of final warnings prior to the relevant public notice, SARS did not explicitly cite this as the reason for reversing the penalties.<\/p>\n

This temporary relief for South Africa’s trusts has ended, as SARS has recently resumed issuing final demands for outstanding income tax returns.<\/p>\n

According to Tax Consulting SA, these notices began distribution in October 2026, indicating a return to enforcement following the earlier cancellation of penalties.<\/p>\n

\u201cFinal demand letters issued in October 2026 indicate that SARS has recommenced its enforcement after concerns raised regarding the legal validity of the initial penalty process, led to the temporary reprieve,\u201d it stated.<\/p>\n

Tax Consulting SA noted that this move from SARS indicates a renewed readiness to enforce previously cancelled penalties.<\/p>\n

\u201cThe message is clear: while the earlier penalties were reversed, the underlying obligation to submit trust income tax returns remain unchanged,\u201d it emphasized.<\/p>\n

The organization pointed out that trustees have had ample time to fulfill the tax return requirements and to organize their trust affairs accordingly.<\/p>\n

\u201cTrustees as representative taxpayers for a trust, have been given adequate notice and sufficient time to regularise their trusts\u2019 affairs,\u201d it added.<\/p>\n

\u201cTrust compliance has long been an area of concern for the tax authority, and it has repeatedly warned trusts and trustees of the obligation to meet their tax filing requirements.\u201d<\/p>\n

The organization cautioned that non-compliant trusts face administrative penalties that could amount to R16,000 monthly.<\/p>\n

\u201cPenalties are determined under section 211 of the Tax Administration Act and range from R250 to R16,000 per month, depending on the applicable statutory penalty category,\u201d it explained.<\/p>\n

\u201cThese penalties may continue for up to 35 months as long as non-compliance persists.\u201d<\/p>\n

With final demands now being issued by SARS, Tax Consulting SA advises trusts to act promptly to meet their tax obligations.<\/p>\n

\u201cThe latest development suggests that the hourglass is fast running out for trusts with outstanding income tax returns,\u201d it remarked.<\/p>\n

\u201cTrustees should urgently review their trusts\u2019 compliance status and submit any overdue income tax returns within the required 21-business-day timeframe.\u201d<\/p>\n

\u201cThey must also ensure that any previously reversed penalties are indeed cleared from their SARS accounts.\u201d<\/p>\n

The group also highlighted that inactive trusts are not exempt from income tax obligations and can be penalized by SARS as well.<\/p>\n

\u201cDormant or inactive trusts are not automatically exempt from filing obligations and should pursue formal deregistration where appropriate,\u201d it noted.<\/p>\n<\/div>\n
