The Chief Whip of the African National Congress (ANC) Parliamentary Caucus, Cde Mdumiseni Ntuli, intends to file criminal charges against Dr. Mark Burke, a Member of Parliament from the Democratic Alliance (DA), along with his company, Kastelo. This decision comes amid serious allegations involving approximately R4 billion in transactions that are reportedly being investigated by the South African Reserve Bank (SARB).
This action is prompted by increasing concerns over financial accountability, adherence to South African laws, and the expected standards of conduct for a serving Member of Parliament, particularly one who has held positions within Parliament’s finance-related oversight committees. The ANC Parliamentary Caucus has acknowledged the DA’s choice to remove Dr. Burke from the finance portfolio; however, this measure is seen as an inadequate public relations tactic.
Simply reshuffling committee positions does not equate to accountability. After a thorough assessment of the situation, the ANC Parliamentary Caucus firmly believes that the allegations warrant a comprehensive, impartial, and unhindered investigation by qualified law enforcement entities. There should be no political safeguarding, interference, or attempts to obstruct this process.
The ANC Parliamentary Caucus has also released an urgent media advisory, inviting journalists to attend the official filing of criminal charges at the Cape Town Central Police Station.
The event is scheduled for Friday morning at 10:00 AM.
In their official communication, the caucus emphasized that this legal action represents a significant step to ensure that the recent allegations are formally presented to the appropriate law enforcement authorities.
The caucus pointed out that this move is crucial for establishing an undeniable set of facts related to the issue at hand.
“The purpose of laying the criminal charge is to formally present the allegations to the relevant authorities, ensure that the facts are clearly established, and hold accountable anyone found responsible for criminal behavior in accordance with the law,” the statement noted.
Additionally, the caucus suggested that a transparent legal process is vital for maintaining public and institutional focus on the substance of the allegations, avoiding any possible distractions or diversions.
The briefing will occur at 28 Buitenkant Street, where the Cape Town Central Police Station is located.
