Nearly four years following one of the most tragic events involving youth in South Africa, the KuGompo Regional Court in the Eastern Cape has issued a pivotal ruling that could lead to criminal charges regarding the deaths of 21 young individuals at the Enyobeni Tavern.

In the ruling delivered during the inquest regarding the incident, the court concluded that the fatalities were caused by crowd crush asphyxiation due to the victims being trapped inside the overcrowded tavern. It determined that these deaths stemmed from the negligence of multiple individuals responsible for the tavern and its oversight.

The court identified negligence on the part of Sergeant Thabile Kondile, tavern proprietor Vuyokazi Ndevu, tavern manager Siyakhangela Ndevu, bouncer Thembisa Diko, and Eastern Cape Liquor Board official Zuko Lizani, all contributing to the tragic deaths.

The court has called for the prosecution of all five individuals.

This ruling signifies a crucial development in a case that has captured national attention since the incident occurred at the Enyobeni Tavern in Scenery Park, KuGompo City. The loss of the teenagers and young adults ignited widespread public anger and renewed debates on underage drinking, tavern oversight, law enforcement accountability, and overall public safety.

In response to the ruling, the South African Police Service (SAPS) acknowledged it had received the court’s findings but stated it was not yet prepared to provide a comprehensive comment.

SAPS indicated that its legal team has neither received nor completed a thorough review of the full judgment.

“As such, the SAPS is not in a position at this stage to provide a detailed or substantive response to the court’s findings and any directives contained therein,” the police stated.

The police requested patience as legal advisers evaluate the ruling before deciding on the next steps.

“Once that process is complete, we will be able to engage meaningfully on the contents and determine the appropriate way forward, including any internal actions or broader policy considerations that may be required.”

SAPS reaffirmed its dedication to upholding the law and promoting transparency, adding that a full response would follow after completing its legal review and internal discussions.

The police also extended their condolences to the victims’ families.

“We reiterate our heartfelt condolences to the families of the deceased and assure all South Africans that we take this matter with the utmost seriousness.”

The court’s recommendation does not constitute a criminal conviction. Whether formal charges will be initiated is up to the relevant prosecuting authorities.

For the families who have spent years seeking answers, the judgment marks a significant milestone in a lengthy and difficult pursuit of accountability following one of South Africa’s most tragic nights.
